Writ of Habeas Data - Ngayon ko lang nalaman kung ano eto





Ang writ of habeas data ay paraan para maprotektahan ang inyong personal na impormasyon kapag ito ay ginagamit nang hindi tama. Pero ano nga ba ito? At paano ito makakatulong sa inyo?

Ang Writ of Habeas Data ay parang legal na proteksyon para sa ating personal na impormasyon. Halimbawa, kung may kumukuha, nagkakalat, o ginagamit ang impormasyon mo—katulad ng pangalan, litrato, o detalye ng buhay mo—nang walang pahintulot mo, puwede kang humingi ng tulong sa korte gamit ang Writ of Habeas Data.

Lahat tayo puwedeng gumamit ng Writ of Habeas Data. Pero madalas, ginagamit ito ng mga taong naabuso o biktima ng maling paggamit ng impormasyon. Halimbawa:

Kapag may nagpo-post ng personal mong litrato o detalye online para siraan ka.

O kaya naman, kung may nagbabantay o nagmamanman sa’yo nang wala kang alam.

Pwede mong gamitin ang Writ of Habeas Data para malaman kung sino ang gumagawa nito at para mapatigil sila.

Ganito ang proseso para ma-avail ang proteksyon na ito:

1. Hain ng Petisyon. Pumunta sa korte at magsabi ng reklamo. Ikwento kung paano ginagamit ang impormasyon mo nang mali.

2. Order ng Korte. Kapag inaprubahan ng korte ang petisyon mo, uutusan nila ang kabilang panig na ipaliwanag kung bakit nila ginagamit ang impormasyon mo.

3. Proteksyon. Kung mapatunayan na mali ang ginagawa nila, ipag-uutos ng korte na itigil ito at burahin ang impormasyon na hawak nila."

Ngayon, sa panahon ng social media at teknolohiya, madalas nagagamit ang impormasyon natin nang hindi tayo pumapayag. Halimbawa, may kumakalat na fake news tungkol sa’yo o may taong naninira gamit ang private details mo. Ang Writ of Habeas Data ay isang paraan para sabihin: 'Tama na, protektado ang karapatan ko.' Karapatan nating lahat ang privacy

Tandaan, ang Writ of Habeas Data ay para sa proteksyon ng bawat isa laban sa maling paggamit ng personal na impormasyon. Kung tingin mo kailangan mo ito, huwag matakot magtanong o humingi ng tulong sa abogado o korte.
